Securing electronic evidence involves the acquisition of data with the aim of ensuring
that it is not in any way altered, thus making it admissible in a court of law.
All evidence must be secured by specialised personnel otherwise you risk the
evidence becoming inadmissible. For example, if the people investigating are not
impartial (such as workers from the company itself or subcontractors); or if they
do not possess the necessary knowledge of forensic methodology to guarantee
that the evidence is not tampered with at the scene or during the subsequent chain
of custody.
Evidence can also be rejected if the integrity of the data or the date of its acquisition
cannot be verified: i.e. If the fundamental rights of the users affected by the
investigation have not been observed.
